Delegations of authority are required in order to provide officers of the City with the power to exercise duties and make determinations which will improve the efficiency of the local government's operations.
Section 5.42 of the Local Government Act 1995 (the Act) allows a local government (Council) to delegate to the Chief Executive Officer the exercise of any of its powers or the discharge of any of its duties under the Act, except those prescribed in Section 5.43. All delegations made, amended or revoked by the Council must be by an absolute majority decision.
Section 5.44 of the Act allows the Chief Executive Officer to delegate any of these powers to an employee of the City. Delegations of authority from the Chief Executive Officer to an employee must be in writing and are subject to any conditions imposed by Council and the Chief Executive Officer.
All delegations must be reviewed by the delegator (both Council and the Chief Executive Officer), at least once every financial year.
